Katter’s Australian Party (KAP) has introduced a Bill to Queensland Parliament which would establish Castle Doctrine in the state, essentially allowing a property’s resident(s) to use whatever force is appropriate to repel or defend against intruders.

While the right to defend oneself and one’s property is already in the state Criminal Code, it is subject to provisions including that the force used is “necessary”. Under the Criminal Code (Defence of Dwellings and Other Premises—Castle Law) Amendment Bill 2024, the fact someone is illegally in another person’s home is enough to make the use of force “necessary” should the homeowner have to use it.
